Overview:
The Privacy Counsel will play a pivotal role in ensuring Insmed's compliance with data privacy laws and regulations across the US. This position requires a strategic problem solver with a legal background in data privacy who can lead initiatives, provide expert guidance, and collaborate with team members to manage privacy risks effectively.
Responsibilities:
Key Responsibilities- Serve as a U.S. data privacy subject matter expert providing practical, business-focused guidance on data privacy, data protection, and AI-related matters (e.g., CCPA; HIPAA; CAIA).
- Collaborate with IT, Compliance, and other global cross-functional partners with privacy, data, and record management and retention responsibilities to help set strategy and lead privacy related matters.
- Support and advise legal team members on privacy, data protection, and AI-related issues in vendor engagements, including drafting, reviewing, and negotiating Data Processing Agreements (DPAs) with vendors.
- Stay up to date with privacy, data protection, and AI laws, regulations, and commercial developments to proactively advise business teams on the impact and develop forward-thinking advice on approaches to compliance.
- Draft and update privacy and data protection policies, guidelines, forms, and training tools to assist the organization in achieving its strategic objectives while complying with privacy regulations.
- Work cross-functionally to complete Data Privacy Impact Assessments (DPIAs), data flow maps, processes, procedures, and privacy by design implementations.
- Handle and process all third-party data requests, including Data Subject Access Requests (DSARs), from contractors, vendors, impacted individuals, and other external parties.
- Provide advice and guidance in the event of a data breach.
Skills & Abilities:- Demonstrated collaborative approach with cross-functional partners.
- Ability to exercise outstanding judgment regarding the analysis, interpretation, and application of regulations, guidelines, and requirements, development of policies and procedures, and selection of appropriate courses of action.
- Must have excellent communication skills (verbal and written).
- Ability to identify problems and work to implement solutions.
- Highly organized with a strong attention to detail, transparency, accuracy, and conciseness.
- Ability to interact successfully in a dynamic and culturally diverse workplace.
- Ability to work in a hybrid environment
Qualifications - JD Degree from an accredited Law School
- Member in good standing of the Bar of a state, a territory of the United States, or the District of Columbia and ability to obtain a New Jersey limited in-house counsel license
- 3+ years of experience supporting clients on data privacy laws. This can include a combination of corporate and/or law firm positions.
- Knowledge of privacy requirements in Europe and Japan is a nice to have.
- At least one core IAPP CIPP, CIPM, or CIPT certification a plus.
- Experience supporting clients within the healthcare, life sciences or similar industry focused on data privacy preferred.
- Agility and willingness to broaden areas of expertise to include employment law is helpful.
