Department Overview
The Data Protection Counsel – Information Security serves as a member of the Motorola Solutions, Inc. Data Protection - Products team and a subject matter expert on privacy and security compliance. In addition, this role will serve as legal and compliance advisor to the Market Readiness and Customer Due Diligence Response Teams in the development and maturity of their Market Readiness security and privacy maturity and Customer Information Security Due Diligence Response Programs. While the Data Protection Counsel will report to the Sr. Privacy Counsel, Information Security and Services, he/she will also work closely and collaboratively with the services organization, internal product, engineering, legal, cybersecurity, compliance operations and business teams.

Job Description

Responsibilities:

  • Serve as data protection subject matter legal and compliance expert to cybersecurity, legal, service and global product teams. Provide advice and counsel on relevant global privacy and security laws, standards and policies. 
  • Serve as subject matter expert to the Customer Due Diligence Response Team in connection with review and approval of responses to customer information security and privacy questionnaires.
  • Review security and privacy related representations in contracts and other public facing documentation for accuracy and appropriateness.  
  • Assist and advise commercial counsel with the evaluation and negotiation of data protection contract terms and conditions.
  • Determine applicability and obligations of privacy and security regulations and frameworks.
  • Participate in cybersecurity and privacy assessments of Motorola Solutions, products and services to advise on the privacy and security compliance implications and develop ways to mitigate compliance risks.
  • Provide guidance to internal teams with respect to data flow mapping and compilation of data and asset inventories.
  • Provide Legal analysis in connection with data protection impact assessments and records of processing activities. 
  • Provide proactive and creative legal guidance on all privacy and data protection compliance risks in connection with the launch of new services. 
  • Maintain expertise in global security and privacy laws and advise on the impact to MSI as well as implications with respect to compliance activities.
  • Assist and advise commercial counsel with the evaluation and negotiation of data protection contract terms and conditions.
  • Develop and provide training to cybersecurity and global service teams regarding privacy, security and other compliance best practices and obligations.
  • Provide reports as directed or requested to keep senior management, DPO and other groups informed of the operation and progress of compliance efforts.

Required Skills & Qualifications:

  • CIPP/US, CIPP/E, CIPT and/or CIPM certifications required.

  • Security certification (CISSP, CIPM, etc) required.

  • Working knowledge of global data and privacy laws and standards. 

  • Working knowledge of NIST RMF, NIST PF, NIST 800-53, ISO 27000 series and SOC2 trust criteria. Working knowledge of FBI CJIS Security Policy desired.

  • General understanding of cloud industry technologies, IaaS, PaaS and SaaS. 

  • Experience with OneTrust Privacy Management Platform desired.

  • Practical yet creative problem-solving approach that emphasizes addressing business needs while protecting companies interests.

Basic Requirements
  • Juris Doctorate degree from an ABA accredited law school
  • Active member of a State Bar Association with authorization to practice within the state in which the employee works
  • 7+ years of professional work experience including 4+ years of work experience as an attorney for private law firm and/or as in-house counsel; direct experience advising global product, service and/or engineering teams on integrating privacy and security into operations, products and services AND 3+ years work experience in a technical capacity for a SaaS, PaaS, IaaS or hybrid (cloud and on-premise) software and services provider.
  • Legal authorization to work in the U.S. indefinitely is required. Employer work permit sponsorship is not available for this position.
